结 语
中国已于2017年完成全国统一性的碳排放权交易市场的运行,《全国碳排放权交易管理条例》(送审稿)一旦通过,将成为行政法规,惩罚制度也是对纳入减排计划名单的控排企业唯一规制手段。惩罚制度的设计需要多元化、具体化、综合化。通过引入组合惩罚、累进惩罚模式,设定惩罚阈值,按照该企业投入减排技术的积极履约成本,合理计算惩罚金额,并将惩罚与政府的财政扶持政策相结合,达到增加控排企业的履约率,促进控排企业合理规划减排计划的效果,达到“梯度处罚,促进履约,一处失信,处处受限”的目标,将信用监督警示与惩戒机制相结合。同时,也为完善中国碳排放权管理条例和保证碳市场有序运行奠定了坚实的理论基础。 本文+内-容-来-自;中^国_碳+排.放_交^易=网 t a n pa ifa ng .c om
